# Landlord's name and address (section 47)

The rule that every written demand for rent, service charges or administration charges must state the landlord's name and address, or the service and administration charges in it are treated as not due.

Also called: section 47, s.47 information, landlord's details on demands.

It's a simple rule that catches people out, because a demand without it isn't payable until the information is given.

## The rule

- Any written demand must contain the **name and address of the landlord**.
- If that address isn't in England or Wales, the demand must also give an address in England and Wales for serving notices.
- If the information is missing, the **service charge or administration charge** in the demand is treated as not due until it is provided (s.47(2)). Sending a corrected demand cures it.

## For self-managed blocks

- **RTM company:** the 1987 Act's references to the landlord include the RTM company, so its demands must give its own name and address. Because the freeholder is still the landlord under the leases, many RTM companies also show the freeholder's name and address.
- **Freehold company:** the company is the landlord, so give its name and registered office address.
- **Residents' management company:** give the details the lease and the law require. If you're unsure, show both the company's and the freeholder's details.
