Address for service (section 48)
Also called: section 48 notice, s.48 address, notice under section 48
An address in England and Wales that a landlord must give leaseholders for serving notices, without which rent and service charges are treated as not due.
Leaseholders need to know where they can send notices (for example, to dispute something or tell you about a sale). Section 48 of the Landlord and Tenant Act 1987 makes the landlord tell them.
The rule
- The landlord must give each leaseholder, by notice, an address in England and Wales at which notices can be served on it.
- Until it does, any rent, service charge or administration charge otherwise due is treated as not due.
- Once it has been given, it doesn't need repeating on every demand, but many managers include it on every demand to be safe.
The other direction
Leases also say where you must send notices to leaseholders, and how (by hand, by post, sometimes by email). Keep each leaseholder's address for service up to date, especially for owners who don't live in their flat.
